Triple Talaq now non-bailable

The government has recently come up with a draft law that aims to end Instant Triple Talaq. Under the new draft, if a Muslim Man tries to divorce his wife by uttering the word ‘Talaq’ three times, he will be sentenced to three years of imprisonment along with a fine.

Moreover, the draft also recognizes the offense non-bailable and cognizable and has been circulated to the states for consultation. It seeks to put a ban on the practice of Triple Talaq in any form be it written, verbal or electronic.

The draft law also allows a woman who has been given instant Triple Talaq to move to the court and she can seek “substinane allowance” for herself as well as dependent children, alongside a custody for the minor kid. A draft legislation framed by the ministerial panel is likely to be tabled in the winter session of Parliament. However, the proposed law is not going to be applicable in Jammu & Kashmir.

The terms of the proposed law have been finalized in discussions held by a Group of Minister (GoM). It included ministers like Rajnath Singh, Arun Jaitley, Sushma Swaraj, and Ravi Shankar Prasad.

Notably, in a landmark judgment on August 22, the Supreme Court had already declared Triple Talaq to be unconstitutional with a 3-2 majority. However, the practice didn’t stop even after the SC verdict. Besides, The Muslim Personal Law Board had also not been able to take any action on the issue.

Hopefully this time, the centre will get a nod from all the states on the draft law. This would help in putting a full stop to the Triple Talaq practice.
