The 5 percent quota given to gurjars in Rajasthan has been freezed by Supreme Court. Rajasthan state has already reached a level where the reservation cannot be stretched further. This is the statement given by Supreme court. It is already known that quota of reserved jobs and education in Rajasthan has exceeded the limit of 50 so it is not possible to stretch it further.

After agitation in August, Rajasthan government had promised to give 5 percent quota to Gujjars. Hence, the reservation for Other Backward Classes is expanded to 26 percent from the present 21 percent. As the total reservation in the state already stands at 49 per cent and after the implementation of new quota, it would have reached 54 percent.

Rajasthan High Court on this order
On this new order by Supreme court, high court said that this new order about not stretching quota was passed on November 13 and made available today. It further added that staying the legislative process was “totally uncalled for and, therefore, that part of the impugned order is stayed”.

What Supreme court said on its verdict
The court, however, added: “Taking into consideration the facts and circumstances of the case and various decisions of this Court, we are inclined to restrain the State Government from taking any action or decision on the administrative side or in any manner conferring the benefit of reservation, which will have the result of crossing the total reservation beyond 50%.” It further added that quota for Gujjars cannot be implemented till High Court makes a decision.
